Terms & Conditions

  1. Interpretation:
  • Contract means a contract (made between the Hirer and Supplier) which includes these terms and conditions. This could include the order form (or any similar document) which has been completed online at www.StriveMobility.com
  • Strive Mobility Ltd (SM) including its agents, employees, directors and any representatives is the Supplier who is renting Products to the Hirer.  SM is still considered the Supplier for the purposes of the contract even when acting as an agent for others
  • Hirer is the person, firm or company (or other organisation) hiring Products from SM
  • Product(s) means any Equipment (together with any accessories) of the specification notified by SM, which SM will rent to the Hirer, as per the contract
  • Service(s) is defined as the hire of product by SM for the duration of the contract
  • Deposit is any advance payment held as security and as is required by SM in relation to the Hire of Products by the Hirer

 

  1. Rental Period
  • The Rental period commences on the delivery date or “Start Date” specified in the contract and terminates on the collection date or “End Date” as per the order form, or if later, then upon any of the following events occurring: a) The return of the products by the Hirer to the Supplier; or b) the physical collection or repossession of the Product by the Supplier
  • The Supplier will arrange for delivery of the Product(s) on, or before,  the day specified in the contract, although delivery times cannot be guaranteed.  If a specific delivery time is required, please contact us once an order has been placed and we will do our best to deliver as per your request
  • If the Hirer wishes to extend the Rental Period, notice must be given 3 working days in advance to allow SM to confirm availability (which cannot be assumed and is not guaranteed) of the Product(s).  Once availability is confirmed, payment will be requested in advance
  • If the Hirer does not make the product available for return on the End date, the supplier will continue to charge the Hirer until such return is made available and product is collected or delivered
  • If the Hirer does not make the product available for return on the End date, the supplier will rearrange collection for which a £50.00 fee will be payable in advance by the Hirer or be taken off from the deposit

 

  1. Basis of Contract
  • The Contract commences when the Hirer places the order and gives his/her authorisation to process payment for the contract, subject to notification of non-acceptance by SM
  • If SM is not permitted (due to no fault on the part of SM) by the Hirer or Venue to deliver/collect the Equipment on the delivery/collection date, the contract will be cancelled, unless the Hirer wishes to rearrange delivery, for which a £50.00 fee will be payable in advance by the Hirer
  • If the Hirer does not make the product available for return on the End date, the supplier will rearrange collection for which a £50.00 fee will be payable in advance by the Hirer or be taken off from the deposit
  • If the Hirer does not make the product available for return on the End date, the supplier will continue to charge the Hirer until such return is made available and product is collected or delivered
  • SM confirms acceptance of the order either via email or telephone call to the Hirer
  • If SM is unable to supply any product for any reason, SM will inform the Hirer either via email or telephone and will arrange for an alternative (similar) product to be supplied, or will offer the Hirer a full refund as soon as possible.  The Supplier will not be liable for any loss suffered by the Hirer as a result of Products not being available for hire
  • The Supplier will not be liable or responsible for any failure to perform, or delay in performance of any of its obligations under the contract that is caused by events outside of its control; these include: non-performance of 3rd party couriers, riot, war, invasion, strikes, natural disaster etc
  • The Hirer confirms that he/she is at least 18 years old and legally capable of entering into contracts
  • The Hirer shall inspect each product hired and delivered pursuant to the contract.  If there are any faults upon inspection, the Hirer must inform the Supplier within 1 day of receiving the Product, after which time the Supplier will presume that the Hirer has received and accepted the product as specified in the contract.  Any claims that the product was not delivered in a fully functional order after 1 day of delivery, will not be considered
  • The Hirer must inform the Supplier of non-delivery within 24 hours of the start date, otherwise the product will be deemed as being received
  • SM is not making any recommendations or providing any advice as to which Product (including its size or accessories) may or may not be suitable for the User and SM accepts no liability for any injury caused to the User as a result of an unsuitable Product being hired by the Hirer
  • We do not provide any training on the use of the mobility equipment (including its accessories).  If you do not have the required training, or have any concern in their application then the equipment should not be hired

 

  1. Payment, Charges, Credit/Debit Cards
  • The Hirer is responsible for paying:

a) The hire charge agreed in the contract, payable in advance

b) The amount of deposit (if applicable) as quoted to the Hirer or as is shown in the Online Order/Booking Form

c) Any charge for loss or damage resulting from non-compliance with Clause 6 below

d) The cost of repairing or replacing the product if it is damaged, lost or stolen during the Rental Period (which includes any agreed extension to the initial rental period) even if it is not the fault of the Hirer.  This cost will be reduced by any deposit amount taken at the outset, or by any accepted insurance claim – if insurance was taken out on the product

e) Any charges for delivering or collecting the product and other charges which the Hirer has been notified of in advance

f) All relevant charges even if the Hirer has asked someone else to be responsible for the product

g) The cost of any damage caused by the User to another party and/or property, unless adequate insurance has been taken out and the insurance claim accepted

  • SM may off-set the Deposit against amounts owed by the Hirer to SM.  If the Hirer fails without due cause to make any payment of the Charges or any Replacement Cost or causes any loss or damage to the Product(s) or packaging, SM shall be entitled to apply all Deposits held against such default, loss, Replacement Cost or damage
  • Total Booking Cost does not include any additional items you may select at a later stage, or any other costs arising from the rental (such as damage, cleaning etc)
  • The Hirer gives SM permission to use any debit/credit card provided for any outstanding payments for which the Hirer is liable
  • If SM is not permitted (due to no fault on the part of SM) by the Hirer or Venue to deliver the Equipment on the delivery date, the contract will be cancelled, unless the Hirer wishes to rearrange delivery, for which a £50.00 fee will be payable in advance by the Hirer
  • If the Hirer does not make the product available for return on the End date, the supplier will rearrange collection for which a £50.00 fee will be payable in advance by the Hirer or be taken off from the deposit
  • If the Hirer does not make the product available for return on the End date, the supplier will continue to charge the Hirer until such return is made available and product is collected or delivered
  • Payment shall not be deemed to be made by the Hirer until the Supplier has received cleared funds in respect of the full amount outstanding
  • The Hirer shall pay all sums due to the Supplier under this contract without any deductions, counter claims and/or any other withholding of monies
  • SM reserves the right to change prices on its website
  • Payments must be in UK Pounds.  Prices on our website that are shown in any other currency are approximate only, based on the available exchange rate at that time
  • All payment processing is done via a 3rd party and SM will not receive or process any credit card information.  The payment processor is Stripe and their website is: https://stripe.com/gb
  • Any deposits will be refunded in full only after the product(s) are received in satisfactory condition and all relevant charges are paid.  If the product is damaged or any parts are missing upon return, the required amount to compensate the supplier will be deducted from the deposit
  • The Hirer is responsible for paying for the replacement cost of any hired Product (and packaging) which are lost, stolen or damaged beyond economic repair during the Rental period.  This amount would be reduced or offset by any successful insurance claim (where relevant) or any deposit taken in advance
  • The Hirer will be liable for damage, loss or any other costs caused by the continued use of defective products after a defect has been found or a defect is suspected by the Hirer
  • The Hirer is responsible for any expenses (including loss of rental income) incurred on the Supplier as a result of any breakdown in the Product caused by the user’s negligence

Subject to status and at our discretion, we can offer Limited Companies net 30 day invoice accounts for purchase only items (Account customers).  Please email us at info@strivemobility.com.  We reserve the right to withdraw or restrict your credit account at any time:

  • The risk of damage to or loss of the Goods shall pass to the Account Customer upon delivery of the Goods
  • The Supplier shall retain title to and ownership of the Goods and the Account Customer will hold them as Supplier’s custodian and fiduciary agent until the Supplier has received payment in full of all sums due under the Contract
  • If the Account Customer fails to make any payment to the Supplier when due: the Account Customer’s right to sell, use or otherwise dispose of the Goods shall terminate immediately; the Supplier has the right to withhold delivery of any undelivered products and stop any products in transit; all sums unpaid in respect of the Goods supplied under the Contract shall become immediately due and payable.  In the event of overdue payment the Company may charge interest at the higher of a rate of five per cent above the base lending rate from time to time of Lloyds Bank or such rate as is set down in any relevant statute. Such interest will accrue, compounded on a daily basis, from the date upon which payment was due until payment in full and shall continue both before and after judgement

Discounts, Offers, Coupons, Promotions (via codes) are made available for certain products from time to time but we reserve the right to amend/revoke these codes at any time

 

  1. Product Description
  • SM will do its best to ensure that the product you receive will correspond in all material respects with the description that is published on our website.  However, at times the actual item delivered could vary from the picture or description on the website; nevertheless SM will attempt to make sure that all written descriptions are as accurate as possible so that the Hirer knows what they will be receiving in advance

 

  1. Care and Use of Products (including packaging)
  • The Hirer is responsible for:
  1. Looking after the Product and any accessories (keys, charging equipment etc)
  2. Locking the product (if applicable) and charging the battery (if applicable) when not in use
  3. Protecting any Product and packaging from adverse weather conditions which could result in damage
  4. Using and storing the hired product(s) in line with any recommendations provided by the manufacturer (which would be available on the internet or in the User Manual provided)
  5. Making sure that the products are returned in the condition and in the same packaging (including pallets) that they were supplied in
  6. Equipment must be thoroughly wiped down and cleaned to prevent cross infection prior to return
  • The Hirer will use the product as recommended by the manufacturer and not in any unsafe or illegal way and will not recklessly use the product that could endanger themselves or others
  • The Hirer will not sell, rent or dispose of the product and will not allow unauthorised persons to use the product
  • The Hirer must inform SM as soon as becoming aware of any defects in the Product otherwise SM will not be responsible for any loss or damage to the product found at the end of the rental period
  • The Hirer must ensure they contact the Supplier (or insurer where relevant) as soon as they become aware of any defects in the Product or if the Product breaks down.  Allowance will be made in relation to the rental cost for any non-use of the Product due to a breakdown caused by an inherent fault and/or fair wear and tear.  For any motorised equipment (Scooters, Power Chairs, Profiling Beds, Hoists), please contact the warranty company directly if the Product(s) breakdown
  • The Hirer must not attempt to repair any Product unless the Supplier has agreed to this in writing
  • The Hirer is responsible for keeping the products clean and the equipment must be thoroughly wiped down and cleaned to prevent cross infection prior to return
  • The Hirer is responsible for arranging the collection of the hired Product(s), making sure that the Product is readily available to collect at the end of the rental period and must ensure that any Product is left in the same condition as when it was received and packaged (where applicable) in the same way
  • The Supplier assumes that the User has some prior experience with handling the equipment
  • Some of our couriers deliver items via pallet delivery, where the product itself is protected by pallet collars.  The hirer is responsible for unpacking the equipment and then repacking them prior to collection.  Unpacking/packing instructions may be sent in advance.  If the product(s) is not packed as per instructions or as when it was received and, as a result, our couriers refuse to accept the product(s), then a fee of up to £100 will be charged

 

  1. Breakdown, Loss, Damage, Accidents
  • The Hirer is liable for paying for the cost of any repair to, and/or cleaning of the Product as a result of the Product being returned in a damaged, unclean and/or defective state (except where due to reasonable wear and tear as determined by the Supplier)
  • The Supplier is responsible for the cost of maintaining and/or repairing the product, which is required as a result of fair wear and tear or an inherent fault (as long as the Supplier is notified of such problems by the Hirer).  Where products are insured, the supplier is responsible for maintaining the insurance premiums which would then enable a claim to be made (should one be required)
  • The Hirer must ensure they contact the Supplier (or insurer where relevant) as soon as they become aware of any defects in the Product or if the Product breaks down.  Allowance will be made in relation to the rental cost for any non-use of the Product due to a breakdown caused by an inherent fault and/or fair wear and tear.  For any motorised equipment (Scooters, Power Chairs, Profiling Beds, Hoists), please contact the warranty company directly if the Product(s) breakdown
  • The Hirer is responsible for paying for the replacement cost of any hired Product (and packaging) which are lost, stolen or damaged beyond economic repair during the Rental period.  This amount would be reduced or offset by any successful insurance claim (where relevant) or any deposit taken in advance
  • The Hirer will be liable for damage, loss or any other costs caused by the continued use of defective products after a defect has been found or a defect is suspected by the Hirer
  • The Hirer is responsible for any expenses (including loss of rental income) incurred on the Supplier as a result of any breakdown in the Product caused by the user’s negligence
  • The Hirer must inform SM and the insurance company of any accident immediately.  It is the Hirer’s responsibility to get all the information about the accident including the names and addresses of anyone involved, including any witnesses.  The Hirer must make the Product secure if it is safe to do so and if the Hirer is in a position to do so

 

  1. Ownership, Insurance and Liability
  • SM does not always own Products marketed on the website and can act as an agent for others when renting Products to the Hirer
  • The Hirer has no right, title or interest in the Product other than as a Hirer
  • Risk in the Hire of Products will immediately pass to the Hirer when they leave the possession of the Supplier (or the Supplier’s courier); this risk will not pass back to the Supplier until the hire Products have been collected by the Supplier
  • Please note that any Products booked are subject to cancellation fees as per below
  • The Hirer assumes all risk and liability for any loss, damage or injury, including death, to persons or property of the Hirer or others arising out of the use, operation of the equipment
  • Nothing in any contract or these conditions shall exclude or limit either party’s liability for death or personal injury caused by negligence, for fraudulent misrepresentations or for any other liability which cannot be legally excluded or limited
  • The Hirer will indemnify SM against any liability or breach of any of these conditions by the User
  • The Supplier shall have no liability or suffer any loss or any other costs caused by the Hirer’s continued use of defective Products after the defect has been found, a defect is suspected or should reasonably have become apparent to the Hirer
  • SM will not be held liable for any accidental damage caused to the venue or property whilst delivering/collecting the Product
  • The Supplier will not be liable for any loss suffered by the Hirer as a result of Products not being available for hire
  • The Supplier shall not be liable for any loss or damage, whether direct or indirect, consequential or otherwise arising from the hire by the service user of the equipment including any liability to any third party
  • SM is not making any recommendations or providing any advice as to which Product(s) (including its size or accessories) may or may not be suitable for the User and SM accepts no liability for any injury caused to the User as a result of an unsuitable product being hired by the Hirer
  • SM shall not be liable or responsible for the loss of or damage to any property left, lost, damaged, stolen, stored or transported by the Hirer, its agents, servants, or employees, or any other person on or using the equipment. The Hirer assumes all risk of such loss or damage and waives all claims against SM
    by reason thereof and the Hirer agrees to hold SM harmless from and to
    defend and indemnify SM against all claims based upon or arising out of such loss or damage
  1. Delivery and Collection
  • The Supplier is responsible for arranging delivery and collection of the Product(s) from the address provided by the Hirer
  • The Hirer or any other authorised parties may be asked to sign a Delivery or Collection note to acknowledge receipt of the product(s) in good and usable condition
  • The Hirer must inform the Supplier of any non-delivery within 24 hours of the due delivery date, otherwise the product will be deemed as being received
  • The Hirer must ensure that the delivery and collection address are accurate at the time of booking and to let SM know of any changes in advance.  The Hirer must also ensure that the venue itself (hotel, apartment, hospital etc) allows the Supplier (including its courier) to enter their property.  SM will not be held liable for any accidental damage caused (to the venue or property) whilst delivering/collecting the product
  • If SM is not permitted (due to no fault on the part of SM) by the Hirer or Venue to deliver the Equipment on the delivery date, the contract will be cancelled unless the Hirer wishes to rearrange delivery, for which a £50.00 fee will be payable in advance by the Hirer
  • If the Hirer does not make the product available for return on the End date, the supplier will rearrange collection for which a £50.00 fee will be payable in advance by the Hirer or be taken off from the deposit
  • The Hirer will remain liable for on-going hire charges where a collection was unable to be made due to the actions of the Hirer, until the product is collected by Supplier (or its agents)
  • Some of our couriers deliver items via pallet delivery, where the product itself is protected by pallet collars.  The hirer is responsible for unpacking the equipment and then repacking them prior to collection.  Unpacking/packing instructions may be sent in advance.  If the product(s) is not packed up as per instructions or as when it was received and as a result our couriers refuse to accept the product(s), then a £100 fee will be charged

 

  1. Termination by Notice, Cancellations, Refunds
  • The Hirer has the right to terminate the contract at any time.  Notice of termination must be provided via email (info@StriveMobility.com)
  • Cancellation within 14 working days from the date of order is free of charge and entitles the Hirer to a full refund
  • The Hirer loses their right to a full refund on this contract should delivery be requested within less than 14 working days from the date of order
  • Cancellation fees are as follows:
  1. At least 14 working days before delivery – No Fee
  2. 4 and 13 working days before delivery – 50% cancellation fee
  3. within 3 working days of delivery – 100% cancellation fee
  • Rental charges cannot be refunded once the product has been dispatched, irrespective of whether the Product has been used or not
  • The Supplier shall be entitled to terminate the contract by giving not less than 30 days’ notice to the Hirer

Due to the hygienic and infection control properties, we are unable to accept returns or offer refunds on non faulty PPE products

In all cases of dispute the law which is applied is that of England

12. Covid Protocol

  • All products will be cleaned, disinfected, or wiped down prior to the start of the hire period
  • The hirer is responsible for wiping down all products before repacking them at the end of the hire period
  • After the Product is collected by our couriers it will remain in quarantine in our warehouse/storage facility for at least 10 days before being inspected.  Any deposits will be refunded in full only after the product(s) are inspected and only if received in satisfactory condition and all relevant charges are paid.  If the product is damaged or any parts are missing upon return, the required amount to compensate the supplier will be deducted from the deposit
